A Federal Trade Commissions rule banning prerecorded sales calls without a consumer's consent took effect Sept. 1. The recorded sales call ban applies to all prerecorded telemarketing messages (including those answered by an answering machine) and is waived only when the caller has the recipient's signed, written permission. (Electronic permission using a lawful e-signature is okay.) The calls must also contain an automated opt-out mechanism at the beginning of the message. The rule doesn't prevent companies from making prerecorded informational messages such as reconfirmations of appointments or reservations. More from NAR Legal Affairs here.
