HUD Places Restrictions on Selling Home Warranties

On June 25, HUD issued a new interpretive rule that imposes severe restrictions on the ability of a real estate licensee to accept compensation from a home warranty company under RESPA. As a result, all REALTORS® should immediately review the terms of any marketing agreements they have entered into with home warranty companies to ensure they are not violating RESPA, which could result in various criminal and civil penalties including a fine up to $10,000 per violation and a year in prison.
